A federal judge in Virginia dismissed the criminal cases against former FBI Director James Comey and New York AG Letitia James because interim U.S. Attorney Lindsey Halligan’s appointment violated federal law, expiring after 120 days in May 2025.
Halligan, a former White House aide without prosecutorial experience, had secured Comey’s indictment for alleged false statements and James’s for bank fraud claims.
The dismissals are without prejudice, but Comey’s case likely can’t be refiled due to the expired statute of limitations; the Justice Department has not commented on next steps.
