Ben Roberts-Smith has lost his appeal against a defamation ruling

Ben Roberts-Smith has lost his appeal against a defamation ruling that found, on the balance of probabilities, that he was complicit in the killing of unarmed prisoners in Afghanistan.

He was found to be a war criminal and murderer. It has been funded by Kerry Stokes. Will likely be appealed to the High Court of Australia.

The Victoria Cross recipient had previously lost his case against reporting done by The Age and Sydney Morning Herald, and journalist Nick McKenzie.

Roberts-Smith must now pay costs to Nine Newspapers
