{"id":8563,"date":"2024-02-05T10:34:23","date_gmt":"2024-02-05T00:34:23","guid":{"rendered":"https:\/\/www.vibewire.com.au\/?p=8563"},"modified":"2024-04-04T07:48:48","modified_gmt":"2024-04-03T21:48:48","slug":"call-for-parliamentary-inquiry-to-investigate-governance-issues-within-aboriginal-corporations","status":"publish","type":"post","link":"https:\/\/www.vibewire.com.au\/?p=8563","title":{"rendered":"Call for parliamentary inquiry to investigate governance issues within Aboriginal Corporations"},"content":{"rendered":"\n<p>A staunch advocate for Aboriginal land and water rights says Victoria\u2019s&nbsp;<a href=\"https:\/\/www.heraldsun.com.au\/news\/victoria\/cultural-heritage-laws-stalling-victorias-big-build-developers\/news-story\/a2dd7164fcf4df506c79f8002b0d7359\">cultural heritage laws<\/a>&nbsp;have been \u201chijacked\u201d by individuals who use \u201cstandover tactics\u2019\u2019 to funnel money into some Aboriginal corporations.&nbsp;<\/p>\n\n\n\n<p>Binjali-Ngarket-Ngintait man Darren Perry helped the state government draft&nbsp;<a href=\"https:\/\/www.heraldsun.com.au\/news\/victoria\/concerns-that-costs-are-being-passed-on-to-consumers-making-housing-even-more-unaffordable\/news-story\/df50f29ccd921018d00a1a9a3fc7067a\">cultural heritage laws in the early 2000s,<\/a>&nbsp;but says in the decades since they have increasingly become exploited by \u201cgangster-like\u201d figures who are tarnishing their predecessors\u2019 work for financial gain.&nbsp;<\/p>\n\n\n\n<p>Mr Perry has accused some Aboriginal corporations of extorting developers, farmers and the government, contributing to&nbsp;<a href=\"https:\/\/www.heraldsun.com.au\/news\/victoria\/concerns-that-costs-are-being-passed-on-to-consumers-making-housing-even-more-unaffordable\/news-story\/df50f29ccd921018d00a1a9a3fc7067a\">soaring house prices and crippling construction.<\/a><\/p>\n\n\n\n<p>He is calling for a parliamentary inquiry to investigate loopholes in the laws and governance issues in Aboriginal corporations.<\/p>\n\n\n\n<figure class=\"wp-block-image\"><img loading=\"lazy\" decoding=\"async\" width=\"1024\" height=\"768\" src=\"https:\/\/www.vibewire.com.au\/wp-content\/uploads\/2024\/02\/image.jpeg\" alt=\"Binjali-Ngarket-Ngintait man Darren Perry helped the Victorian government draft cultural heritage laws in the early 2000s. Picture: Rob Leeson<\/p>\n\n\n\n<p>Mr Perry, who was involved in consultations during the creation of the Cultural Heritage Act 2006, said the legislation must protect Aboriginal land rights but should not be used as a \u201cgravy train\u201d to line individuals\u2019 pockets.&nbsp;<\/p>\n\n\n\n<p>\u201cThe Act was not meant to extort money out of developers,\u201d he said.<\/p>\n\n\n\n<p>\u201cThis is extortion. I know what standover tactics are, and that\u2019s what\u2019s going on.\u201d<\/p>\n\n\n\n<p>His calls come after the Herald Sun revealed developers faced delays of more than a year at the cost of millions of dollars due to legally mandated cultural heritage requirements.&nbsp;<\/p>\n\n\n\n<p>The delays have been flagged as a roadblock to the Allan government\u2019s ambitious plan to build 800,000 homes over the next decade.&nbsp;<\/p>\n\n\n\n<p>But Premier Jacinta Allan is refusing to consider a review of cultural heritage laws, saying Registered Aboriginal Parties (RAPs) were one of many third-party agencies developers needed to get approvals from and should not be \u201csingled out\u201d.&nbsp;<\/p>\n\n\n\n<figure class=\"wp-block-image\"><img loading=\"lazy\" decoding=\"async\" width=\"1024\" height=\"768\" src=\"https:\/\/www.vibewire.com.au\/wp-content\/uploads\/2024\/02\/image-1.jpeg\" alt=\"Jacinta Allan is refusing to consider a review of cultural heritage laws. Picture: David Crosling<\/p>\n\n\n\n<p>Mr Perry, the former chairman of the First People of the Millewa Mallee Aboriginal Corporation in northern Victoria, warned the laws were also causing issues on government projects, including the Murray-Darling Basin Plan.&nbsp;<\/p>\n\n\n\n<p>Projects on culturally sensitive land \u2013 which are mostly within 200m of waterways \u2013 require a cultural heritage management plan that must be ticked off by the local RAPs.&nbsp;<\/p>\n\n\n\n<p>Mr Perry raised allegations of criminals cottoning on to the money-making laws, saying they had linked up with some Indigenous families to game the system.&nbsp;<\/p>\n\n\n\n<p>\u201cIt\u2019s a cartel. Picture: Rob Leeson<\/p>\n\n\n\n<p>\u201cA good measure of how wealth is being distributed is whether Aboriginal kids are in school, whether they have food on the table?\u201d he said.&nbsp;<\/p>\n\n\n\n<p>\u201cAll this money and we\u2019re still failing at the grassroots.<\/p>\n\n\n\n<p>First Nations Assembly co-chairman Reuben Berg also backed adjustments to the law but argued Indigenous groups should have more power. He said greater resources for RAPs would enable them to be more responsive and reduce delays.
