its Federal Court case to remove videos<\/a>&nbsp;of the Wakeley terrorist stabbing on Elon Musk\u2019s social media platform X and will now test the validity of its powers through the Administrative Appeals Tribunal.<\/p>\n\n\n\n<p>X, formerly known as Twitter,&nbsp;<a href=\"https:\/\/www.theaustralian.com.au\/nation\/federal-court-ends-temporary-block-on-australians-viewing-bishop-stabbing-footage-on-x\/news-story\/710747417afac077f46d77d3ff2dfb19\">claimed a major victory last month<\/a>&nbsp;after Federal Court Justice Geoffrey Kennett lifted a temporary order to hide videos of the stabbing across its global audience, which the social media giant never complied with.<\/p>\n\n\n\n<p><a href=\"https:\/\/www.theaustralian.com.au\/nation\/politics\/court-interim-order-for-x-to-hide-sydney-bishop-attack-video\/news-story\/1301c45adc5d1ca02458d0145486bcc8\">Following the April stabbing of Bishop Mar Mari Emmanuel<\/a>&nbsp;in a western Sydney church, eSafety Commissioner Julie Inman Grant invoked the Online Safety Act, passed by the Coalition in 2021, to demand the removal of \u201cclass 1 material\u201d.<\/p>\n\n\n\n<p>The legal fight sparked a&nbsp;<a href=\"https:\/\/www.theaustralian.com.au\/inquirer\/its-for-your-own-good-isnt-a-good-enough-argument-pm\/news-story\/93d3ca564c9bda726a8a3f4406dd5045\">brawl over freedom of speech and online harm<\/a>, fuelled by Mr Musk\u2019s claims of censorship and debate over unfettered powers of social media giants to allow publication of violent and extremist content.<\/p>\n\n\n\n<p>In his decision to deny the eSafety Commissioner\u2019s application to extend an interlocutory injunction on footage posted by X, Justice Kennett said a global ban was not a \u201creasonable\u201d step under Australian law because it would be \u201cignored or disparaged in other countries\u201d.<\/p>\n\n\n\n<p>Ms Inman Grant on Wednesday said \u201cI have decided to discontinue the proceedings in the Federal Court against X Corp in relation to the matter of extreme violent material depicting the real-life graphic stabbing of a religious leader at Wakeley in Sydney on 15 April
