Norfolk Southern Corporation announced Tuesday that it has reached a $600 million<\/span>\u00a0agreement in principle to resolve a consolidated class action lawsuit relating to the\u00a0East Palestine<\/span>\u00a0derailment. If approved by the court, the agreement will resolve all class action claims within a 20-mile radius from the derailment and, for those residents who choose to participate, personal injury claims within a 10-mile radius from the derailment.<\/p>\n

This is another promise kept by Norfolk Southern to make it right for the people of\u00a0East Palestine<\/span>\u00a0and the surrounding communities. In\u00a0March 2023<\/span>, the company made\u00a0commitments to address<\/a>\u00a0three long-term concerns of residents: drinking water, home values, and healthcare. Already, the company has announced programs for\u00a0drinking water<\/a>\u00a0and\u00a0home value assurance<\/a>. The company is going further through this comprehensive settlement\u2014providing additional, significant monetary relief to individuals, including for healthcare, and to help qualifying local businesses continue to rebuild and grow.<\/p>\n

The agreement is designed to provide finality and flexibility for settlement class members.\u00a0 Individuals and businesses will be able to use compensation from the settlement in any manner they see fit to address potential adverse impacts from the derailment. This could include healthcare needs and medical monitoring, property restoration and diminution, and compensation for any net business loss. In addition, individuals within 10-miles of the derailment may, at their discretion, choose to receive additional compensation for any past, current, or future personal injury from the derailment.<\/p>\n

This settlement furthers the work Norfolk Southern has done to make it right in\u00a0East Palestine<\/span>\u00a0and the surrounding communities. In addition to this settlement, Norfolk Southern has made contributions including:<\/p>\n

$104 million<\/span>\u00a0in community assistance to\u00a0East Palestine<\/span>\u00a0and the surrounding areas in\u00a0Ohio<\/span>\u00a0and\u00a0Pennsylvania<\/span>, including\u00a0$25 million<\/span>\u00a0for a regional safety training center,\u00a0$25 million<\/span>\u00a0in planned improvements to\u00a0East Palestine\u2019s<\/span>\u00a0city park,\u00a0$21 million<\/span>\u00a0in direct payments to residents, and\u00a0$9 million<\/span>\u00a0to local first responders;
\n$4.3 million<\/span>\u00a0to support upgrades to drinking water infrastructure;
\n$2 million<\/span>\u00a0for community-directed projects;
\n$500,000<\/span>\u00a0grant for economic development; and
\nOngoing support to the community through the Family Assistance Center and programs such as the Interim Value Assurance Program.<\/p>\n
